Indian Privacy Law Framework — Your Legal Rights Explained
India has a developing but robust legal framework governing the privacy of personal data. As an Indian e-commerce business, Alvencia operates under multiple laws and rules that directly protect you as a user. We explain each of these below so you are fully informed of your statutory rights.
The Information Technology Act, 2000 (IT Act)
The IT Act is the primary legislation governing electronic commerce and digital data in India. Section 43A of the IT Act requires any body corporate that handles sensitive personal data or information (SPDI) to implement and maintain reasonable security practices. Section 72A makes unauthorised disclosure of personal information without consent a punishable offence with imprisonment of up to 3 years or a fine of up to Rs. 5 lakh, or both. Alvencia is bound by this law and complies fully with its requirements.
The IT (SPDI) Rules, 2011 — Sensitive Personal Data or Information Rules
These rules, notified under Section 43A of the IT Act, define what constitutes Sensitive Personal Data or Information (SPDI) and impose obligations on how it must be collected, stored, transferred, and disclosed. Under these rules, SPDI includes passwords, financial information such as bank account, credit card, and debit card details, physical, physiological, and mental health conditions, and other similarly sensitive categories. These rules require us to obtain your consent before collecting SPDI, use it only for the purpose for which it was collected, and not retain it longer than necessary. You have the right to withdraw your consent at any time by contacting us.
The Digital Personal Data Protection Act, 2023 (DPDPA)
The Digital Personal Data Protection Act, 2023 was enacted by the Parliament of India and received Presidential assent on 11 August 2023. It is the most comprehensive personal data protection legislation in India to date. While its rules and operational provisions are being notified in phases, Alvencia is proactively aligning its data practices to comply with its requirements. Under the DPDPA, you have the following rights as a Data Principal (a person whose personal data is processed): the right to obtain information about your personal data being processed; the right to correction and erasure of inaccurate or outdated personal data; the right to grievance redressal from the Data Fiduciary (us); the right to nominate another individual to exercise rights on your behalf in case of your death or incapacity; and the right to approach the Data Protection Board of India if your grievance is not resolved satisfactorily. Alvencia, as a Data Fiduciary, is obligated under this Act to process personal data only for lawful purposes with your consent, maintain accuracy of data, implement appropriate security safeguards, notify you in the event of a personal data breach, and not retain your data beyond the period for which it is necessary.
The Consumer Protection (E-Commerce) Rules, 2020
These rules require every e-commerce entity operating in India to clearly disclose its privacy policy, inform users about the personal data it collects and how it is used, and ensure that users are not subjected to unfair data practices. Alvencia complies fully with these rules and this policy constitutes our required disclosure under Rule 4 and Rule 5 of these regulations.
The Right to Privacy — Article 21 of the Constitution of India
The Supreme Court of India in its landmark judgment in Justice K.S. Puttaswamy (Retd.) v. Union of India, (2017) 10 SCC 1, unanimously held that the right to privacy is a fundamental right guaranteed under Article 21 of the Constitution of India, which protects the right to life and personal liberty. This constitutional recognition forms the foundational basis of all data protection frameworks in India. Alvencia acknowledges this right and treats the protection of your personal information as a fundamental obligation, not merely a compliance requirement.
Advertising Platform Compliance: Alvencia uses Google Ads, Google Analytics, and Meta (Facebook/Instagram) advertising tools as described in Section 5 of this policy. These platforms require merchants to maintain a clearly published and accessible privacy policy that discloses what data is collected, how it is used, and how users can exercise their rights. This Privacy Policy satisfies those requirements. To the extent we participate in any additional Google or Meta merchant programme in the future, we will update this policy to disclose the relevant data practices.
What Personal Information We Collect
We collect several types of personal information to serve you better. We only collect what is necessary for the specific purpose, such as processing your order or responding to your query.
3.1 Information You Provide Directly to Us
| Category | Specific Data Collected | When Collected |
|---|---|---|
| Identity & Contact Information | Full name, email address, mobile phone number | Account creation, checkout, contact forms, newsletter signup |
| Address Information | Shipping address, billing address | Checkout, order placement |
| Payment Information | Payment method (card, UPI, net banking, COD) and confirmation of payment. We do not store your sensitive payment details, such as credit/debit card numbers or banking credentials, on our servers — these are handled directly by our trusted third-party payment gateway. | Checkout and order payment |
| Account Information | Login email and password (if you create an account); we encourage you to keep this password strong and unique | Account registration |
| Order and Transaction Information | Products ordered, order status, order history, delivery updates, and any issues you raise about an order | Order placement and fulfilment |
| Communications | Emails, chats, and calls to customer support. Correspondence may be logged and recorded for quality and training purposes, including call recordings or chat transcripts, which we protect just like other personal data. | Support interactions |
| Third-Party / Contest Data | Basic profile information if you log in via social media (should we offer that option in future), or information you share by entering a contest or survey | Optional, with your consent |
3.2 Information We Collect Automatically
When you use alvencia.com, certain technical data is collected automatically, including:
- Your IP address, which provides general location information (city or region level only).
- Browser type and version, and device identifiers.
- The pages you visit on our site, the time and date of your visit, and the time spent on those pages.
- Other diagnostic data, such as error logs, used to identify and resolve technical issues.
- Cookies, pixels, and similar identifiers used to remember your preferences (such as items in your cart or your login status) — see Section 5 for full detail.
3.3 Information We Receive Through Third Parties
We may receive information about you in connection with our relationships with the following third parties, which we combine with the information you provide to us directly:
- Payment gateway (Razorpay): confirmation of payment status for your order.
- Courier and logistics partners: delivery status and delivery attempt updates for your order.
- Google Analytics (GA4), Google Ads, and Meta (Facebook/Instagram) Pixel: aggregated and pseudonymised website and advertising performance data — see Section 5.
- Social media platforms: if we offer social login in the future and you choose to use it, or if you interact with us on those platforms.
- Contests and surveys: information you provide if you choose to participate.
What We Do Not Collect: We do not collect Aadhaar numbers, PAN card numbers, passport numbers, biometric data, or any government-issued identification numbers unless you are specifically required to provide them for a legal or regulatory purpose and you provide them voluntarily. Any sensitive personal information (such as passwords or financial information) is collected only over secure channels. You have the option not to provide certain information, but you may then be unable to use some of our services — for example, we need a shipping address to deliver products.
How We Use Your Personal Information
We use your personal information strictly for legitimate business purposes. We do not use your data in any way you would not reasonably expect, and we believe in minimising data use to only what's truly needed.
| Purpose of Use | Data Used | Legal Basis |
|---|---|---|
| Processing and fulfilling your orders, shipping your products, and updating you on order status or issues | Name, address, contact information, payment information | Contractual necessity; IT Act, 2000; Consumer Protection Act, 2019 |
| Providing customer support and responding to your questions, requests, and concerns | Name, email, phone, order details, communication content | Contractual necessity; Consumer Protection Act, 2019 |
| Personalising your experience — recommending products you might like or tailoring content and offers you see | Past purchases, browsing history | Your consent via cookie acceptance; legitimate interest |
| Sending updates and promotional communications (new products, offers, newsletters) if you have given consent | Email, phone number | Your explicit consent; DPDPA, 2023; TRAI regulations for SMS marketing |
| Sending transactional communications (order confirmations, shipping notifications, policy changes) — sent even if you opt out of promotions, as these are part of our service to you | Email, phone number | Contractual necessity; Consumer Protection (E-Commerce) Rules, 2020 |
| Analytics and improvement — understanding how users navigate our site, what's popular, and where issues occur | Largely aggregated, anonymised usage data | Legitimate interest; IT Act, 2000 |
| Security and fraud prevention — detecting and preventing fraudulent or suspicious activity, and investigating potential violations of our Terms of Service | Device/IP data, account activity, order history | Legitimate interest; IT Act, 2000; DPDPA, 2023 |
| Complying with legal obligations — e.g. maintaining transaction records for tax and accounting purposes, or responding to a lawful request from public authorities such as a court order | As required by the relevant authority | Legal obligation; IT Act, 2000; applicable Indian law |
We do not sell or rent your personal information to third parties for their own marketing. Every piece of data we collect has a defined purpose. If we wish to use your data for a new purpose in the future, we will update this policy and, where required under the DPDPA, 2023, obtain fresh consent from you before proceeding.
Cookies and Tracking Technologies
Like most websites, Alvencia™ uses cookies and similar tracking technologies (pixels and tags) to enhance your experience and analyse how our site is used. Here is what we employ and why:
Essential Cookies
These are necessary for the website to function — they keep you logged in during your visit, remember items in your shopping cart, and enable core site features. You can disable cookies via your browser, but some parts of our site may not work properly if you do.
Analytics — Google Analytics 4 (GA4)
We use Google Analytics 4 (GA4) to collect information about website traffic and user behaviour — which pages are most visited, how users move through the site, and where they come from (e.g. a Google search or a social media link). This data is aggregated and anonymised; we look at trends, not individual user behaviour. GA4 may collect your IP address (which provides general location info), but we do not allow it to collect personally identifiable information like your name or email. If you wish, Google provides an opt-out browser add-on that prevents GA from collecting your data on any website.
Advertising & Conversion Tracking — Meta Pixel
The Facebook Pixel (Meta Pixel) helps us measure the results of our advertising on Facebook and Instagram — whether you visited our site or took specific actions (like adding to cart or purchasing) after seeing our ad. The Pixel may collect information such as your Facebook User ID (if logged in), your IP, and other device info, used in accordance with Meta's data policy. We see aggregated reports only, not your personal Facebook data. You can adjust your ad preferences on Facebook or block third-party cookies in your browser to limit this.
Advertising & Conversion Tracking — Google Ads
We participate in Google Ads, which means you may see Alvencia™ ads on Google search results or other websites. Google Ads conversion tracking uses cookies to tell us if someone clicked one of our ads and then made a purchase, using an anonymous identifier rather than your personal details. This lets us measure ad effectiveness and manage our advertising spend. You can manage your preferences via Google's Ad Settings, and opt out of personalised advertising if you wish.
Other Third-Party Tools
From time to time we may use other tools or plugins (for example, a chatbot widget or an email newsletter service) that also use cookies or tracking pixels. We will update this policy if any such tool collects personal data not already covered here. Any partner we work with is vetted for strong privacy practices.
Managing Cookies: On your first visit you may see a cookie notification banner where you can accept or manage your preferences. You can also control cookies through your browser settings — most browsers allow you to block or delete cookies, though disabling them may affect site functionality:
- Google Chrome: Settings > Privacy and Security > Cookies and other site data
- Mozilla Firefox: Settings > Privacy and Security > Cookies and Site Data
- Safari: Preferences > Privacy > Manage Website Data
- Microsoft Edge: Settings > Cookies and Site Permissions > Cookies and Site Data
You may also opt out of Google Analytics tracking specifically by installing the Google Analytics Opt-Out Browser Add-on at tools.google.com/dlpage/gaoptout, and manage personalised Google Ads at adssettings.google.com.
How and With Whom We Share Your Information
We treat your personal information with care and do not share it with third parties except in the specific and limited circumstances described below, and always with appropriate safeguards in place.
Courier and Logistics Partners
We share your name, delivery address, and mobile number with our courier/logistics partners solely to deliver your order. They only receive what is necessary to perform delivery and do not receive any of your financial information.
Payment Gateway Provider — Razorpay
We share your name, email, phone number, and order value with our payment gateway partner, Razorpay, to facilitate secure, PCI-DSS-compliant payment processing. Razorpay handles your card or UPI details directly under its own security framework. We do not receive or store your full card number, CVV, or net banking credentials.
IT, Hosting, and Communication Service Providers
We work with IT service providers for hosting our website, and with email/SMS service providers to send order confirmations and updates. All such providers are contractually obligated to protect your data and use it solely for the task we hire them for.
Analytics and Advertising Partners
Platforms like Google and Meta process certain data when we use their analytics and advertising services (see Section 5). This sharing is limited to what's needed for those functions and is often pseudonymised or aggregated. We do not directly hand over your personal contact information to these platforms for advertising — the tools themselves collect data via cookies.
Legal Requirements
We may disclose your information if required by law or in response to a valid request by a government or law enforcement agency — for example, to comply with a court order or a lawful subpoena. We assess such requests carefully and provide only what is legally mandated.
Protection of Rights
If we believe an investigation is necessary, we may share information to enforce our Terms of Service or investigate potential violations (fraud, security breaches, misuse of our site), or where someone's actions threaten the rights, property, or safety of Alvencia™, our customers, or the public.
Business Transfers
In the unlikely event that Roziyo Trading Private Limited undergoes a merger, acquisition, reorganisation, or sale of assets, your personal information may be transferred to the successor entity as part of that transition. Any successor will be bound by the same commitments made in this Privacy Policy. We will notify you (for example, by email or a prominent notice on our site) of any such change and any choices you may have regarding your information.
We do not sell your personal data to any third party for their independent use. All sharing is either with your consent, to serve you, or as required or permitted by law. Where a service provider is located outside India, we ensure data protection measures equivalent to those under Indian law are in place (such as standard contractual clauses).
How Long We Retain Your Data
We retain your personal information only for as long as necessary to fulfil the purpose for which it was collected, including to satisfy any legal, accounting, or reporting requirement.
| Data Category | Retention Period | Reason |
|---|---|---|
| Orders, invoices, and payment records | As long as necessary for audit/tax purposes and to handle disputes or refunds — typically a number of years as required by Indian tax law (commonly around 7 years) | Tax and accounting compliance |
| Account information (active accounts) | For as long as your account is active | Service delivery |
| Account information (following a deletion request) | Removed or anonymised following your verified request, except data we are required or permitted to retain by law | DPDPA, 2023; IT (SPDI) Rules, 2011 |
| Customer support communications | For a reasonable period to manage ongoing service and defend against legal claims | Dispute resolution; service quality |
| Marketing and newsletter consent records | Until you opt out; your contact details may then be kept on a suppression list so we know not to contact you again | TRAI regulations; compliance documentation |
| Website analytics data (GA4, Meta Pixel) | User-level data: typically 14–26 months, per our Google Analytics retention setting, after which it is deleted automatically. Aggregated, anonymised reports may be retained longer. | Website improvement |
When we no longer have a legitimate need or legal obligation to keep your personal information, we securely destroy it or irreversibly anonymise it so that it can no longer identify you. Aggregated, anonymised data that cannot identify you may be retained for business insights.
How We Protect Your Data
Your security is extremely important to us. We implement a variety of technical and organisational measures to protect your personal information from unauthorised access, alteration, disclosure, or destruction, consistent with the Reasonable Security Practices and Procedures requirements prescribed under Rule 8 of the IT (SPDI) Rules, 2011.
Encryption
Our website is secured with SSL/TLS encryption — look for "https://" and the lock icon in your browser's address bar on any page where you enter personal information. Any data transfer, such as logging in or entering payment details, is encrypted in transit.
Secure Payment Processing
We use a PCI-DSS-compliant payment gateway. Sensitive payment information is transmitted directly to the payment processor over encrypted connections. We never see or store your full card number or CVV on our servers.
Access Controls
Access to personal data is restricted to authorised personnel who need it to do their job. For example, our support team can see your order details to help you, but cannot see your password or payment details. Staff are trained in data privacy and security best practices.
Secure Infrastructure
Our hosting and databases employ firewalls, anti-virus, and intrusion detection systems. We keep our software and platforms updated to patch vulnerabilities and regularly monitor our systems for signs of breaches or attacks.
Data Minimisation
We only keep personal data as long as necessary (see Section 7). By not unnecessarily hoarding data we reduce risk, and we dispose of data securely once it is no longer needed.
Third-Party Audits and Certifications
Where applicable, we work with infrastructure providers who hold industry-recognised security certifications (such as ISO 27001 or SOC 2) and undergo regular security audits.
Important Security Note: No method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security. In the unlikely event of a data breach or security incident, we have a response plan in place — we will notify you and the appropriate authorities as required by law and take immediate steps to mitigate any potential harm. You also play a role in keeping your data secure: use a strong, unique password for your Alvencia™ account, do not share it with anyone, log out from shared devices, and contact us immediately at privacy@alvencia.com if you suspect unauthorised access to your account. We will never contact you asking for your password, OTP, CVV, or full card number.
Cross-Border Transfer of Your Data
As an Indian business, our primary operations and data storage are within India. However, because we rely on globally distributed cloud hosting, payments, and analytics/advertising infrastructure to operate alvencia.com, some of your personal data may be transferred to, stored, or processed by service providers located outside India.
Under the IT (SPDI) Rules, 2011, personal data (including Sensitive Personal Data or Information) may be transferred outside India only if the recipient ensures the same level of data protection as required under Indian law. The DPDPA, 2023 also regulates cross-border data transfers and empowers the Central Government to restrict transfers to certain countries or territories.
Our international technology service providers are bound by standard contractual data-processing terms and are required to maintain security standards equivalent to or exceeding those required under Indian law, including — where applicable — industry-recognised certifications such as ISO 27001 or SOC 2 (see Section 8).
By using alvencia.com, you acknowledge that your data may be transferred internationally for the purposes described in this policy, subject to the safeguards described above. If you have concerns about cross-border transfers, please contact us at privacy@alvencia.com.
Your Rights and Choices
We believe it's important that you stay in control of your personal information. Subject to applicable law, you have the following rights regarding your data. You may exercise any of these by using the forms in Section 14, or by emailing privacy@alvencia.com.
Access and Correction
You have the right to access the personal data we hold about you, including your profile details and order history. If any of it is inaccurate or incomplete, you may request correction — many fields can also be updated directly in your account settings.
Data Portability
Under the DPDPA and other applicable laws, you may have the right to request your data in a commonly used electronic format so it can be transferred to another service provider. We will assist as far as technically feasible and as required by law.
Withdrawal of Consent
Where we rely on your consent (such as for marketing emails, cookies, or personalisation), you may withdraw it at any time — click "unsubscribe" in any marketing email, or contact us for other consents. Withdrawing consent does not affect processing carried out before the withdrawal, and if you withdraw consent for something essential (like processing your order), we may not be able to fulfil our services to you.
Deletion (Right to be Forgotten)
You may request that we delete your personal information or close your account. We will honour deletion requests to the extent required by law; however, we may retain certain information for record-keeping, to complete transactions you initiated, or to comply with legal obligations (for example, invoice records required by tax law). Any data we retain continues to be handled in accordance with this Policy.
Objection to Processing
You may object to our processing of your data, for instance for direct marketing. Let us know and we will stop; if you believe our processing impacts your rights and freedoms more broadly, you may object and we will review whether we have a legal requirement to continue.
Grievance Redressal
If you have concerns about how your data is handled, you may raise a grievance with us. We take complaints seriously and respond within the timeframe required by law — see Section 17 for our dedicated Grievance Officer contact and process. If unsatisfied, you may also lodge a complaint with the Data Protection Board of India (once constituted) or the relevant supervisory authority.
Right to Nominate
Under the DPDPA, 2023, you have the right to nominate another individual to exercise your data protection rights on your behalf in the event of your death or incapacity. To register a nomination, contact us at privacy@alvencia.com.
How to Exercise Your Rights: Most basic information can be reviewed or edited by logging into your Alvencia™ account. For anything requiring our assistance — a data export, deletion, or objection — email privacy@alvencia.com with your request. For security, we may need to verify your identity before processing it. We will respond as soon as possible and, at most, within the timeline required by law (typically within 30 days for most requests). We do not charge a fee for exercising your rights, except for requests that are frivolous, extremely impractical, or not required by law — we will always explain our reasoning, and will inform you if we need more time for a complex request.
Children's Privacy
Alvencia™'s website and services are not directed to children under the age of 18. We do not knowingly collect personal information from anyone under 18. Under the DPDPA, 2023, the processing of a child's personal data requires verifiable parental or guardian consent. If you are under 18, please use our website only with the involvement and consent of a parent or guardian.
If we become aware that we have inadvertently collected personal data from a minor under 18, we will take steps to delete that information promptly. Parents or guardians who suspect their child has provided personal information to us should contact us immediately at support@alvencia.com so we can investigate and address the issue.
We do not engage in targeted advertising or profiling directed at individuals known to be under 18, in compliance with the DPDPA, 2023's special protections for children's data. We encourage parents and guardians to educate their children about safeguarding personal information online.
Links to Third-Party Websites
Our website may contain links to third-party websites or services not operated by Alvencia™ — for example, a blog post may reference a scientific study on another site, or we may link to our social media pages. This Privacy Policy applies only to personal information collected by Alvencia™. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party site.
If you click a third-party link, we strongly advise you to review that site's own privacy policy. We aim to only partner with or refer to reputable sites — if you find any external link you feel is inappropriate or unsafe, let us know and we will look into it.
Marketing Communications
We may send you marketing communications about new products, special offers, or other Alvencia™ news by email or SMS, only if you have given consent (for example, by subscribing to our newsletter or not opting out of marketing). We comply with the Telecom Commercial Communications Customer Preference Regulations (TCCCPR) issued by TRAI for SMS marketing.
Every marketing email includes a clearly visible unsubscribe link. You may opt out at any time by clicking that link, or by emailing privacy@alvencia.com with the subject line "Unsubscribe".
Opting out of marketing will not affect transactional communications (order confirmations, shipping notifications, refund confirmations, and other communications necessary to fulfil your order), which are essential service communications and cannot be opted out of.
DND (Do Not Disturb) Registry: If your mobile number is registered on the TRAI National Do Not Call (NDNC) registry, we will not send you unsolicited commercial SMS. If you provided your number at checkout, you may still receive transactional messages (order updates, delivery alerts) regardless of DND status, as these are permitted under TRAI regulations for transactional communications. To opt out entirely from marketing SMS, contact us at privacy@alvencia.com.
Exercise Your Privacy Rights

Deletion of your account is permanent and cannot be reversed.

Google and Meta Advertising Disclosures
Alvencia™ uses Google Ads, Google Analytics, and Meta (Facebook/Instagram) advertising tools as described in Section 5. In connection with these tools, the following specific disclosures apply.
Google Ads Conversion Tracking
We use Google Ads conversion tracking to measure the effectiveness of our advertising campaigns. When you click a Google Ad and complete a purchase on alvencia.com, a cookie records the conversion. This data is aggregated and does not personally identify you to us — it is used solely to measure and improve our ad campaigns.
Google Remarketing
We use Google Remarketing to show our advertisements to users who have previously visited alvencia.com when they browse other websites in the Google Display Network or use Google Search. You can opt out of Google Remarketing at any time via Google's Ad Settings at adssettings.google.com, or by using the Google Analytics Opt-Out Browser Add-on.
Meta (Facebook/Instagram) Pixel
The Meta Pixel helps us measure the results of our advertising on Facebook and Instagram and understand whether you took an action (such as adding to cart or purchasing) after seeing our ad. This data is used in accordance with Meta's data policy. You can adjust your ad preferences directly on Facebook or Instagram.
Changes to This Privacy Policy
We may update or change this Privacy Policy from time to time to reflect changes in our data practices, new services, changes in applicable Indian law (including the operationalisation of provisions under the DPDPA, 2023), or other operational reasons. When we make changes, we will revise the "Last Updated" date at the top of this Policy.
If there are material changes that significantly affect your rights or how we handle your information, we will take additional steps to inform you — for example, by posting a prominent notice on our website homepage or sending you a direct email notification, if you have provided one.
We encourage you to review this Privacy Policy periodically. Your continued use of alvencia.com after any modification constitutes your acknowledgment of the changes and consent to the updated terms. If you do not agree with an update, you may discontinue using our services and request deletion of your data using Form C in Section 14.
